Digital Millennium Copyright Act (DMCA) Policy
At Savoring Moments, we respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their authorized agents may submit a takedown notice to our designated DMCA agent listed below. As an internet service provider, we are entitled to claim immunity from such claims under the “safe harbor” provisions of the DMCA.
Notice of Infringement – Claim
To submit a good faith infringement claim to us, please provide the following information in writing:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work that you claim has been infringed;
- Identification of the material that is allegedly infringing and needs to be removed, along with information reasonably sufficient to allow us to locate the material (please provide the specific URL to assist in locating the content);
- Your contact information, including your name, physical address, email address, phone number, and fax number (if applicable);
- A statement that you have a good faith belief that the material is not authorized by the copyright owner, their agent, or the law; and
- A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Counter-Notification – Restoration of Material
If you believe that material you posted on our site was removed or disabled in error, you may file a counter-notification with us, including the following:
- Your physical or electronic signature;
- Identification of the material that has been removed or disabled and its location before removal;
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and
- Your name, address, telephone number, and email address, along with a statement that you consent to the jurisdiction of the federal court in the district where your address is located or, if you are outside of the United States, that you consent to the jurisdiction of any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of that person.

Misrepresentation and Liability
Please note that under Title 17 USC §512(f), you may be held liable for any damages, including costs and attorney’s fees, if you knowingly make a false claim that material is infringing. We may share the information you provide in a DMCA infringement notice or counter-notification with the person whose content is being reported.
By submitting a claim, you acknowledge and agree that your identity and claim details may be communicated to the alleged infringer.
